In a recent ruling, the Quebec Court of Appeal has mandated a retrial for Carl Girouard, who was previously convicted of first-degree murder in connection with the Quebec City sword attacks on Halloween night in 2020. The attack resulted in the tragic deaths of François Duchesne, 56, and Suzanne Clermont, 61.
Following nearly five days of deliberation in 2022, a jury of 11 members reached a verdict that found Girouard guilty of first-degree murder and five counts of attempted murder for assaulting five other individuals on the same night. Despite admitting to the attacks, Girouard’s defense team argued that his mental state at the time should have precluded criminal responsibility, a stance that the jury did not accept.
During police questioning after his apprehension, Girouard chose to remain silent, a decision that the prosecution interpreted as an indication of his mental lucidity. Conversely, the defense maintained that his silence lent support to their argument.
The Court of Appeal determined that the trial judge erred by failing to provide a specific directive on how Girouard’s silence should be considered by the jury. This lack of a “restrictive instruction” regarding the use of this evidence was deemed to have compromised the fairness of the trial, particularly concerning Girouard’s mental health defense. As a result, the Court of Appeal sided with Girouard, overturning the previous guilty verdict.
In response to the ruling, Quebec’s public prosecutor’s office stated that they are carefully reviewing the decision and refrained from commenting further on the case at this time.
