Harvey Weinstein will not face a fourth trial on a rape charge in New York as prosecutors have decided to drop the case. Jessica Mann, a hairstylist and actress, recounted her allegations during all three trials, claiming that Weinstein had raped her in a Manhattan hotel in 2013. She faced extensive questioning about her intricate relationship with Weinstein before and after the incident. Weinstein, an Oscar-winning producer, denied the accusation, stating that all interactions between him and Mann were consensual. In a letter quoted by prosecutor Nicole Blumberg during court proceedings, Mann expressed her inability to continue with the case, citing the significant harm the 8-year-old ordeal had inflicted upon her.
While prosecutors commended Mann’s courage and strength, they respected her decision not to proceed further, leading to the dismissal of the case by Judge Curtis Farber. Weinstein, maintaining a neutral demeanor, returned to jail awaiting sentencing in September for a separate sexual assault conviction in New York, where prosecutors are seeking a 20-year prison sentence.
Following the conclusion of his New York sentencing, Weinstein faces a 16-year sentence in California for the rape of an Italian actress. He is currently appealing both convictions. Mann testified about her on-and-off relationship with Weinstein, noting her repeated attempts to resist his advances in the hotel room where the alleged assault took place. The latest trial in spring took a visible toll on Mann, who struggled with emotional distress during testimony, citing a recent concussion that affected her ability to focus.
Weinstein’s downfall began with the emergence of sexual assault allegations in 2017, leading to criminal charges in New York and Los Angeles amid the #MeToo movement. Despite some acquittals, Weinstein was convicted in 2020 of rape, a verdict later overturned on unrelated grounds. The subsequent retrials ended in deadlock, ultimately resulting in the dropping of the low-level felony charge against him.
